1. Acceptance of Terms
By accessing and using Gesnatur (the 'Service'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms constitute a legally binding agreement between you and Gesnatur.
2. Description of Service
Gesnatur provides a heliciculture management platform, including tools for tracking production, managing campaigns, and analyzing financial and operational data. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
3. Subscription, Trials, and Payments
The Service is offered on a subscription basis. A 15-day free trial is provided for new users, which requires a valid payment method to initiate. Upon the conclusion of the trial, you will be billed for your selected plan unless you cancel before the trial period ends. Payment processing is handled by Stripe. Gesnatur does not store your credit card or sensitive payment information on its servers; such data is managed securely by Stripe. All payments are non-refundable. You are responsible for all taxes applicable to your use of the Service. We reserve the right to change our pricing upon reasonable notice.
4. User Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Gesnatur cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
5. User Data and Ownership
You retain all rights to the data you input into the Service. You grant Gesnatur a worldwide, non-exclusive license to host, copy, transmit, and display your data solely for the purpose of providing the Service. We do not claim ownership of your data.
6. Prohibited Conduct
You agree not to use the Service for any unlawful purpose or to violate any laws in your jurisdiction. You shall not attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. GESNATUR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT SHALL GESNATUR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gesnatur is established, without regard to its conflict of law provisions.
